Personally I think this is a bogus lawsuit. It was a tragic accident and nothing more. There are serious risks involved in a lot of our daily routines. It's time we stop blaming everyone else when a person does not do want they should have to avoid the incident. There is a reason I touch the door everytime I get out of a vehicle.

Just to give a little more info, the guy died beside the car and by the time someone saw the fire he was already dead so a fire extinguisher would not have solved anything. The none compliant electical equipment had nothing to do with the fire, it was found duiring the investigation. After a certain hour the station closed but they left the pumps on for credit card customers.

The mother of a Camp Hill man who died in a fire at a Cumberland County gas station has filed a wrongful death lawsuit against BP Oil and Toyota, according to her attorneys.

Luther David Byers, 19, was fatally burned March 5 while filling up his Toyota Yaris at a BP station in Lower Allen Township when a static electricity discharge ignited a fire at the pump.

David Rosenberg, of the law firm Handler Henning & Rosenberg, said the lawsuit contends Toyota Motor Corporation and its manufacturing partners failed to adequately design and manufacture car seats and interiors in a way that would minimize the potentially dangerous buildup of static electricity.

The suit also contends that BP Oil did not have an attendant on duty while the station was open to the public, had electrical equipment that was not in compliance with regulations, had no fire extinguishers at the doorway to the station or on the canopy's support column, and failed to post warnings about the dangers of static electricity.

They have warnings on gas pumps. I've seen the news and that these fires happen. Maybe some oblivious people don't know

Maybe they do and they are just too stupid to do anything to protect themselves. That's what life insurance is for.

I don't see giving the automotive industry or the fuel industry a load of crap that leads to some mega lawsuit that ends up costing an already fragile state of things.

Bogus. IMO.

I feel bad for the guy but I am pretty sure if you go to ANY gas station they have directions to ground yourself to the pump before pumping...

Wtf, get out and put gas in it and walk away?

Yah we have the whole 9 yards at the pump about electricity. Absolutely no phones at the pump either.

Sucks but that has no case.

True that. There are multiple "what not to do's" at every pump here. Poor guy, but s*** happens.
